Fakkel van 15 meter voor hoofdkantoor Shell

Milieudefensie roept Shell op de Nigeriaanse gerechtelijke uitspraak te respecteren. 'In Nederland zou het ondenkbaar zijn dat Shell de bevolking willens en wetens blootstelt aan giftige stoffen. Maar dat is precies wat deze oliemaatschappij in Nigeria doet. En dat moet stoppen,' aldus Anne van Schaik, campagneleider Globalisering en Milieu bij Milieudefensie.

In 2005 bepaalde het federale hooggerechtshof in Nigeria dat het affakkelen van gas strijdig is met bepalingen in de grondwet. Affakkelen van gas is een 'grove schending van het grondwettelijke recht op leven en waardigheid, inclusief het recht op een schone, gif -en vervuilingsvrije, gezonde leefomgeving.' Shell fakkelt op tientallen plaatsen in Nigeria gas af.

Het oliebedrijf zegt pas in 2009 te stoppen met affakkelen in Nigeria. Nnimmo Bassey, directeur Environmental Rights Action in Nigeria: 'Shell maakte vorig jaar 25,4 miljard dollar winst. Laat ze daar een deel van gebruiken om de mensen en het milieu in Nigeria te beschermen. We nodigen directeur Jeroen van der Veer uit om naar de Nigerdelta te komen, om zelf eens te ervaren hoe ernstig de gevolgen van zo'n gasvlam zijn. Misschien dat hij dan begrijpt dat nóg drie jaar giftig gas in de lucht, 24 uur per dag, zeven dagen per week, echt te lang is.'

Waarom: Shell stopt niet met affakkelen van gas in Nigeria.

Nergens in de wereld wordt zoveel gas afgefakkeld als in Nigeria. Affakkelen gebeurt als het gas dat bij oliewinning olie vrijkomt, in brand wordt gestoken. De vlammen zijn meters hoog. De hitte is zo groot dat er niets in de buurt kan groeien. Affakkelen veroorzaakt zure regen die de huizen, het oppervlaktewater en de vegetatie aantast. De giftige uitstoot kan astma, chronische bronchitus, ademhalingsproblemen en vroegtijdig overlijden veroorzaken. Ook levert het gas een enorme bijdrage aan klimaatverandering, de vlammen zijn de grootste bron van broeikasgas in sub-Sahara Afrika.

Chronology of the case
Summer 2005: filing of the case: In the summer of 2005, communities from across the Niger Delta have filed a case in the Federal High Court of Nigeria against the Shell, ExxonMobil, ChevronTexaco, TotalFinaElf and Agip joint venture companies, the Nigerian National Petroleum Corporation, and the Nigerian government, to stop gas flaring.

14th November 2005: the Federal High Court of Nigeria:
(1) held that gas flaring is a "gross violation" of the constitutionally-guaranteed rights to life and dignity, which include the right to a "clean poison-free, pollution-free healthy environment";
(2) ordered Shell to stop flaring in the Iwerekhan community immediately;
(3) declared the gas flaring laws to be "unconstitutional, null and void"; and
(4) ordered the Attorney General to meet with the Federal Executive Council to set in motion the necessary processes for new gas flaring legislation that is consistent with the constitution.

16th December 2005: Flaring was still continuing 32 days after the judgment, and so contempt of court proceedings were filed against Shell and NNPC, for disobeying the order.

10th April 2006: The Federal High Court grants a "conditional stay of execution of this court's order stopping gas flaring in the Iwherekan community". Three conditions are attached:
1. Shell and NNPC "are allowed a period of one year from today to achieve a quarterly phase-by-phase stoppage of its gas flaring activities in Nigeria under the supervision of this Honourable Court."
2. The Managing Director of Shell Nigeria, the Group Managing Director of the NNPC, the Nigerian Petroleum Minister, and the Company Secretary of NNPC are ordered to 'submit a detailed phase-by-phase technical scheme of arrangement, scheduled in such a way as to achieve a total non-flaring scenario in all their on-shore flow stations by 30th April 2007'.

26th September 2006: the Court of Appeal in Benin City adjourned Shell and NNPC's jurisdiction appeal, after the case had been wrongly adjourned by court staff to 10th October 2006, without any notice to the applicant or his lawyers. The leading judge said that the reason for this would be
investigated and the person responsible disciplined.

Deadline of April 30th expired:
Shell didn't stop gas flaring.
